Kari Lake’s lawsuit heads to AZ Supreme Court after Court of Appeals rules against her

Former Arizona Republican gubernatorial candidate Kari Lake says her election lawsuit is headed to the Arizona Supreme Court after the appeals court ruled against her. In its ruling, the court ruled that voters were able to cast their ballots and that votes were counted correctly in Arizona during the November midterm elections.

“Lake argues that the superior court erred in dismissing his claims alleging equal protection and due process violations. His arguments fail, however, because those claims were expressly based on an allegation of official misconduct in form of interference with on-site tabulators, the same alleged misconduct as in Lake’s printer/tabulator claim,” the ruling stated.

It continues: “Because these claims were duplicative of a claim that Lake unsuccessfully pursued at trial, the superior court did not err in dismissing them. For the foregoing reasons, we affirm the judgment of the superior court affirming the election of Hobbs as Governor. We deny Hobbs’ request for an award of attorney’s fees on appeal because he offered no substantive basis for the award.”

“The evidence ultimately supports the conclusion that voters were able to vote, that the votes were counted correctly, and that no other basis justifies the election results,” he said.

Lake responded on Twitter to the news, writing, “DURANT: I told you we’d take this case all the way to the Arizona Supreme Court, and that’s exactly what we’re going to do. Sign up, America!”

Earlier this month, Lake said he is “entertaining” a possible run for the U.S. Senate.

During an interview with Charlie Kirk on his Real America’s Voice show, Lake hinted that he might run for Senate in the 2024 election if he doesn’t get a “decent ruling” in his gubernatorial lawsuit Arizona.

When Kirk asked if he was “entertaining” a Senate run, Lake replied, “Yes, I am. I mean my number one priority is our court case, and I have full confidence in our court case and I hope that we’re going to get a judge to do the right thing. But I’m also looking at what happens if we don’t get a decent decision on this, and they want me gone, they want our movement gone. I represent us to the people, and if they want us to go bad that they are willing to steal an election, I will not let them do it, I will not leave.”

“I’ve seen some internal polls that show I’m the only Republican who can beat those other two. I find both incredibly dangerous to the people of Arizona, Kyrsten Sinema’s voting record is 93 percent of times voting for Joe Biden’s agenda, I find Ruben Gallego a self-confessed socialist who is scary for Arizona and if I’m the only Republican who can beat them, I’d be willing to jump in,” Lake added.

I WILL SEE:

“They want our movement to disappear.” @KariLake joins @CharlieKirk11 to weigh in on her lawsuit and possible US Senate run in Arizona.

Lake’s campaign responded to rumors that she is considering a run for the U.S. Senate seat currently held by Krysten Sinema, who quit her party months ago and has now declared herself an independent.

A recent poll showed the fiery Republican defeating independent Sen. Kyrsten Sinema and Democratic challenger Ruben Gallego.

“The poll, released Jan. 11 by the website Blueprint Polling, envisioned a scenario in which Sinema, a former Democrat-turned-independent who has held her Senate seat since 2019, runs for re-election against Lake and Gallego , a Democrat who represents the state’s 3rd Congressional District.. Lake, who has been rumored to be considering a run for the seat but has not confirmed, won 36 percent, according to Blueprint, well ahead of the two rivals. Gallego trailed far behind with 32 percent, while Sinema came in a distant third with 14 percent,” the Deseret News reported.

Since leaving the Democratic Party last month, Sen. Sinema has drawn support from both Republican and Democratic voters, and the poll said her best chance to remain in the Senate “may be if the GOP nominates a candidate as flawed than moderate and conservative”. voters would abandon this person for Sinema Independent.”

Sinema officially left the Democratic Party in December and switched his affiliation to the Independent. His move weakens Democrats’ already tenuous hold on the upper house. Prior to his announcement, Democrats held a 51-50 majority in the US Senate.

In a guest column for the Arizona Republic, Sinema criticized “partisanship” and the control it has over the two major parties. Sinema, who is up for re-election in 2024, said he will stick with Democrats.

Over the past four years, I have proudly worked with other senators from both parties and built consensus on successful laws that help Arizonans build better lives for themselves and their families. 2/3
