Team Biden hopes no one notices this revelation in the special counsel's report

They say success in politics has a lot to do with timing. Getting the right subject in the right way at the right time can make a campaign. Failure to do so may break it.

If this is true, then the person Biden re-elect clicked “send” on fundraising email On Thursday, the “Remember how you felt?” matter, while the president was in the middle of an impromptu news conference denying that he had mental acuity issues that he might want to start looking for another job.

If ever there was an example of bad timing, this is it. How can you read something like that and not think: “It's not a matter of remembering me. Biden?” Totally trampled the message.

Fortunately for Biden and his second-term hopes, the late-night comedians who define political humor didn't pick up on it fast enough to sneak it into their monologues, even though there's nothing quite as funny about it.

However, focusing on which special counsel Robert Hur he wrote On Biden's failed recall in his report on his mishandling of confidential government files dating back to his time as vice president, they missed the most significant nugget of Hur's explanation for why there would be no accusation

Recall that Biden's Justice Department indicted former President Donald J. Trump over the same issue. The results were different, Hur explained, not just because Biden didn't remember things, but because he cooperated with the investigation while Trump didn't.

That should blow the case out of the water. It all but confirms that Trump was singled out for special treatment, as he claimed. The case against him is political, and it's good for America to continue because there's really nothing to it.

As a former president and as a citizen, Trump has rights. You don't have to hand over all the documents they ask the government for. Every outgoing boss enters into a negotiation about what they can take with them when they leave. The rules are not clear at all.

Obviously, they're not supposed to take any of the furniture that was there when they moved in with them (apparently a recent first couple I missed that note). When it comes to documents, the president and the National Archives usually have the time to figure out who is in charge of keeping what.

The former president did not allow himself the same luxury as his predecessors. His suggestion that Biden's Justice Department rushed the case to court to damage him politically now seems stronger.

Equal justice under the law. That's what it says on the pediment of the United States Supreme Court building.

It may not be a reality, and that's being kind, but it's still something we hope for. More importantly, we as a people tend to respond with passion and energy when we see the most essential American doctrine being set aside.

If Biden did any of the things with classified materials that Trump is accused of doing, and Hur's report makes it pretty clear that he did, then the DOJ was wrong not to move forward with an indictment, or it was wrong to to have accused Trump.

Or at least that's a more substantial argument today than when the week started.
