An internal memo obtained by the Washington Free Beacon has shed light on the numerous exemptions present in Joe Biden's executive order aimed at limiting illegal crossings on the southern border. The memo, from Immigration and Customs Enforcement (ICE), reveals that the order contains provisions that allow migrants to enter the United States with an asylum application.

The memo describes the stated purpose of the executive order, which is to “significantly increase the existing consequences for non-citizens who cross illegally.” Its aim is to “decrease encounter rates at the southern border”. However, despite efforts to curb illegal crossings, the memo exposes several loopholes that migrants can exploit to enter the United States.
According to the memo, any “non-citizen” can be allowed entry under “urgent humanitarian” conditions. These conditions explicitly include asylum applications. Migrants who claim to fear an “acute medical emergency,” an “imminent and extreme threat to life or safety,” or who are victims of serious human trafficking may enter the country. The memo notes that deportation officers stationed at the southern border have explicit instructions that do not determine whether noncitizens qualify for an exception to the asylum eligibility limitation.
Even after a migrant is subject to expedited removal, they can still claim a “fear of return,” as noted in the memo. Notably, the note explains that these fears can be non-verbal, such as expressing: “I'm afraid to go to (country).” These claims grant temporary relief from immediate deportation.
To ensure that migrants are informed of their rights, immigration facilities managed by ICE must display visible signage in multiple languages. These signs inform non-citizens how they can “claim fear of return or intent to seek asylum or related protection.”

Joe Biden, who previously said he lacked the executive power to deal with the rise in illegal crossings on the southern border, cited the need to secure the border amid a worldwide migrant crisis in his announcement of the new policy. He stressed that if he did not, an unlimited number of people would try to enter the United States. Since Joe Biden took office, law enforcement has recorded more than eight million illegal border crossings.
