Texas Attorney General Ken Paxton, fresh off his victory against a historic impeachment effort, warns that it is impossible for him to prosecute voter fraud in the state because of a court ruling.
In an interview with Blaze Media’s Glenn Beck, Paxton said the state’s elections are being threatened by district attorneys who will refuse to file charges against those who commit voter fraud in 2024.
“The Texas State Court of Appeals, apparently now, can’t prosecute election fraud in Texas. Is that true?” Beck asked.
“Yes, that’s right,” Paxton replied. “They repealed a 1951 law, and by the way, I have four things I’m supposed to do under the Constitution. The latter is what the law requires. And in 1951, the Legislature directed the Attorney General — it’s the only one I have original jurisdiction over as far as criminal matters, which was voter fraud and the Court of Criminal Appeals.”
“All Republicans, by the way,” he continued, “and by the way, nobody knows who they are. That’s why I think they’ve been put in there, and I’m convinced they’re not Republicans because they invalidated this law and said, ‘I have no authority to go to court as attorney general, because I am in the executive branch.’ That was his reason for the recall, saying it is “unconstitutional” for the attorney general to be on the court. I’m like, is this the craziest decision ever?”
“But they did and now it’s up to the local DAs to prosecute,” he noted.
“Oh my God,” Beck exclaimed.
“Travis County, Dallas County, Harris County, which is Houston, Bexar County stand up, they won’t prosecute voter fraud. Guess what? They just opened voter fraud and the people of Texas he should know. And there are three of the nine members running in March for a primary. We have to find people to run and we have to beat those people or we’re going to lose the state. I tried to get this bill passed again -se so he can start making her again and get her taken down again. And guess who killed him? Dave Phelan. I called them. He never returned my calls, but his team told me no they had time to pass this law…”
“Oh my God,” Beck exclaimed again.
“That’s where we are with Dave Phelan,” he continued. “That’s where we’re at with the Texas House, and that’s where we’re at with the Court of Criminal Appeals that nobody knows about. And by the way, that’s our highest court. It’s like our Supreme Court. Only we’re one of two states that have that for all criminal matters. So I don’t have any right of appeal. So when they consider that unconstitutional and say, I can’t prosecute voter fraud, I don’t have the ability to avoid it. I’m stuck. And that’s what I’m trying to fix.”
“Two years … I can’t prosecute voter fraud,” Paxton added. “And in March I think we’ll have three people running against the members of the Court of Appeal. We have to elect these people. We’re down 8-1, and if we get three new members, at least we’ll be 5-4 and send a message. You can’t hit…”
“That’s a big deal,” Beck noted, before asking, “How did that happen?”
“Okay, I think George Soros, in my opinion, was trying to do three things,” Paxton responded. “First, get the DAs elected in these liberal counties. So he beat every Democrat DA who prosecuted crimes. He did it in Travis County, an unseated Democrat who was actually prosecuting crimes. He did the same in San Antonio. So he got control of that, knowing full well that it would affect the vote. Second, he helped put nine members on the Supreme Court, actually eight. Kevin Yeary is great, the other eight, nobody knows who they are and I think he, because the Republicans don’t know who these people are, got these members of the court to strike down this law. And then the third strategy was to get rid of me. And then there is no hope. There is nowhere to go. So that was the goal. They didn’t get rid of me. So there is still hope and we have to change the Court of Criminal Appeal and we have to get the house next time to pass this law”.
The Texas Court of Criminal Appeals judges running for partisan election in 2024 are: Sharon Keller, Barbara Hervey i Michelle Slaughter. All of them voted to bar Paxton from prosecuting voter fraud in Texas.
Gov. Greg Abbott and Lt. Gov. Dan Patrick agreed with Paxton that the Texas Court of Criminal Appeals should reconsider in 2021. decision which stripped the attorney general of the authority to prosecute cases of voter fraud.
Paxton warned after the ruling that it could be “devastating for future elections in Texas.”
