Ozaukee County, Wis. – The Ozaukee County District Attorney has announced that no criminal charges will be filed against Deputy Michael Zilke in the fatal shooting of Christopher Sewell in November. This decision was made after a thorough investigation by the State Department of Justice.

Deputy Zilke reportedly shot 29-year-old Christopher Thomas Sewell multiple times in the front of the body, including a fatal shot to the forehead. The incident occurred in the city of Grafton after officers said Sewell had brandished a firearm, posing a threat to law enforcement.

Ozaukee County District Attorney Adam Gerol stated, “I … conclude that there is no basis to consider or issue criminal charges against any of the law enforcement officers involved in this incident.” Gerol also highlighted the use of lethal force by law enforcement officers when confronted by an armed suspect who poses a threat of serious physical harm.

That shooting happened while officers were trying to arrest Sewell for an incident on Oct. 30. Sewell was reported to have allegedly threatened neighbors with a gun when they complained about loud music emanating from the apartment where he was staying on Lakefield Road.

Further investigation revealed that Sewell had forced his way into a neighboring apartment, brandishing a gun and making threats after a neighbor raised concerns about the noise. Authorities identified Sewell through a Ring video camera belonging to another neighbor, and it was discovered that Sewell had been staying at the apartment of a woman with a warrant against him, despite her denial of its presence.

In addition, Sewell had several outstanding warrants for his arrest from Milwaukee and Kenosha counties, which intensified police efforts to apprehend him. Police surveillance on Nov. 2 led to Sewell leaving the apartment building in a red Oldsmobile Bravada around 11 a.m. When officers attempted a traffic stop, Sewell fled the scene but eventually lost control of the vehicle after a tire deflation device was deployed.

From there, Sewell attempted to escape on foot into a wooded area before allegedly turning on Deputy Zilke while holding a gun. The firearm, later identified as a Tara Aerospace 9mm handgun, was found underneath Sewell after the incident. Life-saving measures and CPR were performed, but unfortunately, Sewell succumbed to his injuries.

During the announcement, District Attorney Gerol expressed his sorrow for the loss of life, but stated that Sewell's own behavior led to the tragic outcome of the incident. Gerol said, “Simply put, Christopher Sewell forced Deputy Zilke into a situation where there was nothing else he could do but protect his own life and fulfill his oath to protect the public.”

The decision not to file charges against Deputy Zilke in the shooting of Christopher Sewell has sparked discussions about the complexities of law enforcement encounters and the use of force to defend public safety. This case serves as a poignant reminder of the challenges law enforcement officers face when dealing with potentially deadly situations.
