According to the Starr County Sheriff’s Office, Lizelle Herrera was arrested and served with an indictment “on the charge of Murder after Herrera did then and there intentionally and knowingly cause the death of an individual by self-induced abortion.”
The issue at hand is that abortion is illegal after six weeks, and the law allows you to sue abortion doctors performing illegal abortions. Well she did it herself, so technically she is the doctor, and they arrested her for performing an illegal abortion.
This is going to be an interesting case, because the law only allows for civil recourse, there’s no criminal provisions in the law. I guess technically they can sue her in civil court for performing the illegal abortion, but the arrest might come back to bite them in the ass on this one.
