The Supreme Court on Monday threw out multiple conflicting lower court decisions on the Biden administration's vaccination mandate for federal employees as well as members of the military.
The Supreme Court unoccupied decisions in three cases of the DC circuit Court of Appeals, the Fifth Circuitand the Sixth Circuit after finding that there was no longer a live controversy. President Joe Biden revoked executive order establishing the mandate for federal employees in May and the Department of Defense (DOD) removed its mandate in January
“The Fifth Circuit wrongly upheld a national preliminary injunction barring the government from enforcement [the executive order]that required civilian federal employees to be vaccinated against COVID-19,” Biden's admin he said the Fifth Circuit court in the case. “The government's appeal of this preliminary action became moot when the President revoked EO 14,043 several weeks after the Fifth Circuit entered judgment.”
The fifth circuit Found in a case brought by a group known as Feds for Medical Freedom that the Biden administration could not have authority over “private and irreversible medical decisions made in consultation with private medical professionals outside the federal workplace.”
The high court's decision means that the appeals court's precedent will not be a factor in future decisions on the issue.

Justice Ketanji Brown Jackson, the sole Biden appointee to the Court, dissented from the majority's decision in two of the cases. Jackson has frequently been critical of the legal procedure used to overturn the rulings, known as Munsingwear vacatur. dissidents of its use.
“In my view, the party seeking vacatur has not established an equitable right to this remedy,” he wrote.
