The Supreme Court has rejected the emergency of the Biden-Harris administration request to enforce parts of a new rule protecting transgender students under Title IX.

The decision to reject the petition came after a 5-4 vote by Supreme Court justices on Friday.

That request would have allowed biological men to use women's bathrooms, locker rooms and bedrooms in 10 states where there are state and local rules prohibiting such activity.
The general rule was introduced in April and clarified that discrimination based on gender identity, sexual orientation and “pregnancy or related conditions” is prohibited under Title IX's ban on discrimination by “sex” in schools.
The Biden-Harris administration had insisted that the regulation does not affect sports eligibility. However, several experts had disputed that claim, presenting evidence that the rule would eventually allow more biological males to participate in women's sports.
More than two dozen Republican attorneys subsequently joined to file a lawsuit challenging the rule. They argued that it would conflict with some of the state laws that prohibit transgender students from participating in women's sports.
The Supreme Court's decision, therefore, has dealt a major blow to the ongoing efforts of the Biden-Harris administration to ensure transgender inclusion.

“On this limited record and in its requests for urgency, the Government has not provided this Court with a sufficient basis to alter the lower courts' tentative findings that the three provisions held to be potentially unlawful are intertwined and affect other provisions of the rule,” he said. indicates the unsigned order of the court.
