Manhattan District Attorney Alvin Bragg’s office had an “elegant” response to congressional investigators seeking transparency about its political prosecution of former President Donald Trump.

“Stop calling us with that crap,” Bragg’s representatives told a House judicial staffer Wednesday after she made several attempts to reach him by phone.

On Monday, House Republicans sent a letter to Bragg’s office warning him that a politically motivated prosecution of a former president would interfere with the constitutional election.

“You are about to engage in an unprecedented abuse of prosecutorial authority: the impeachment of a former President of the United States and current declared candidate for that office,” the letter said. “This indictment comes after years of your office searching for a basis, any basis, on which to file charges, finally settling on a new legal theory unproven anywhere in the country and rejected by federal authorities to follow. If these reports are accurate, your actions will erode confidence in the impartial administration of justice and irrevocably interfere with the course of the 2024 presidential election. In light of the serious consequences of your actions, we expect you to testify about what clearly appears to be a politically motivated decision by the prosecution.”

Bragg’s general counsel, Leslie Dubeck, has refused to comply with a House Oversight Committee investigation, calling it “an unprecedented investigation into a pending local prosecution.”

“Charter requests are an illegal incursion into New York’s sovereignty,” Dubeck argued. “The investigative jurisdiction of Congress derives from and is limited by its power to legislate on federal matters.”

“We request an opportunity to meet and meet with committee staff to better understand what information the DA’s office can provide that is related to a legitimate legislative interest and that can be shared in accordance with the prosecutor’s constitutional obligations of the district,” he wrote.

On Saturday, House Republicans rejected a letter to Bragg’s office insisting on his constitutional authority to investigate the matter.

“Our committees are conducting oversight of your reported effort to impeach a former President of the United States and current declared candidate for that office,” the letter reads. “On March 20, 2023, we wrote to you to request that you voluntarily cooperate with our oversight by providing relevant documents and testimony.”

“We received a response letter sent on your behalf dated March 23, 2023, outlining several reasons why you may not be able to cooperate with our investigation,” the letter continued.

“Notably, your response letter did not challenge the central allegations at issue: that you, under political pressure from left-wing activists and former prosecutors in your office, are planning to use an alleged federal campaign finance violation , previously rejected by federal prosecutors. , as a vehicle to extend the statute of limitations on a misdemeanor and to indict a former President of the United States for the first time in history. Additionally, you are apparently trying to upgrade a misdemeanor charge to a crime using an unproven legal theory while simultaneously downgrading felony charges to misdemeanors in most other cases in your jurisdiction,” the letter added.

“Contrary to the central argument set forth in your letter, this matter does not involve only local or state interests,” the letter continued. “Rather, the potential criminal prosecution of a former President of the United States by an elected local prosecutor of the opposing political party (and who will face the prospect of re-election) implicates substantial federal interests, particularly in a jurisdiction where it’s about judgment. judges are also popularly elected. If state or local prosecutors can participate in politically motivated prosecutions of US presidents (past or current) for personal acts, that could have a profound impact on how presidents decide to exercise their powers while in office.”

The grand jury trial in Donald Trump’s case was abruptly suspended last week after surprise defense witness Robert Costello impeached the testimony of Bragg’s star witness, former Trump lawyer and convicted perjurer Michael Cohen.
