WASHINGTON — House Oversight and Accountability Committee Chairman James Comer (R-Ky.) today is asking the National Archives and Records Administration (NARA) to provide then-Vice President Joe Biden’s records about his duties as vice president that overlapped with those of his son. activities in Ukraine. President Comer is requesting all unredacted documents and communications in which then-Vice President Joe Biden used a pseudonym; Hunter Biden, Eric Schwerin or Devon Archer is copied; and all drafts of then-Vice President Biden’s speech to the Rada of Ukraine in December 2015.

“Joe Biden has claimed there was an ‘absolute wall’ between his family’s foreign business schemes and his duties as vice president, but evidence reveals access was wide open for influence peddling in the his family. We already have evidence of then-Vice President Biden talking, dining and drinking coffee with his son’s foreign business associates. We also know that Hunter Biden and his associates were briefed on then-Vice President Biden’s official government duties in countries where had a financial interest in. The National Archives must provide these unredacted records to further our investigation into Biden family corruption. said President Comer.

In August 2019, then-presidential candidate Joe Biden stated that when he was vice president there was “an absolute wall between the personal and the private and the government” and “that’s why I’ve never talked to my son or the my brother, or anyone else in the distant family about their business interests, period.” Witness testimony reveals then-President Biden spoke over the phone with his son’s foreign business partners more than 20 times, dined with corrupt foreign oligarchs in Washington, DC, and met his son’s Chinese business partner for coffee in Beijing Emails in NARA’s custody also reveal how Hunter Biden and his associates were copied into official government email.

Dear Dr. Shogan:

The Oversight and Accountability Committee is investigating President Biden’s meetings and communications with certain family members and their business associates during his tenure as Vice President. The National Archives and Records Administration (NARA) has released the Biden Vice Presidential Collection of Records, which contains information relevant to the Committee’s work. Many of these records have been redacted for release under the Presidential Records Act (PRA) and the Freedom of Information Act (FOIA). In order to further our investigation, it is essential that the Committee review these documents in their original format.

The Committee requests special, unrestricted access under the PRA to case number 2023-0022-F, entitled “Vice President Biden and Hunter Biden-Relating to and/or Email Messages Related to Burisma and Ukraine,” which has been published in NARA website. These records have been redacted for public release in accordance with the PRA and FOIA. For example, an email with the subject line “Friday Time Card” is partially retained under restrictions “P6” and “b(6),” which denote personal information about the subject under the PRA and FOIA , respectively. Attached to this email, and available on the NARA website, is a document indicating that on May 27, 2016 at 9:00 a.m., Vice President Biden had a call with the President of Ukraine, Petro Poroshenko . However, the Committee is concerned that this document was sent to “Robert L. Peters,” a pseudonym that the Committee has identified as then-Vice President Biden. In addition, the Committee questions why the son of then-Vice President Hunter Biden, and only Hunter Biden, was copied in this email to then-Vice President Biden.

In order to further our investigation, the Committee must review these documents in their original format. The Committee also requests access to other documents and information described below. Please provide these documents by August 31, 2023:

  1. Complete, unredacted versions of all documents in case number 2023-0022-F;
  2. Any document or communication in which a pseudonym of Vice President Joe Biden was included as the sender, addressee, copied or included in the content of the document or communication, including but not limited to Robert Peters, Robin Ware and JRB Ware;
  3. Any document or communication in which Hunter Biden, Eric Schwerin or Devon Archer has been included as the sender, recipient, copied or included in the content of the document or communication; i
  4. All drafts from November 1, 2015 to December 9, 2015 of then-Vice President Biden’s speech to the Rada of Ukraine on December 9, 2015.

Special access to presidential records may be granted “to Congress” and “to the extent of their jurisdiction, to any committee … if such records contain information necessary for the conduct of their business and not otherwise available way…” ” In addition, the PRA subjects Vice Presidential records to its provisions “in the same manner as presidential records.”

The Committee’s need for these Vice Presidential records is specific and well documented. The Committee seeks to develop legislative solutions aimed at the deficiencies it has identified in the current legal framework regarding ethics laws and the disclosure of financial interests related to the immediate family members of vice presidents and presidents, deficiencies that may put them at risk American national security and interests. The Committee is concerned that foreign nationals have sought access and influence by maintaining lucrative business relationships with immediate family members of high-profile political figures, including members of the Biden family. For additional information on the Committee’s legislative intent regarding its investigation of the Biden family’s international business dealings, the Committee would refer you to three bank records memoranda it has released this year.

The Committee on Oversight and Accountability has specific jurisdiction over NARA under House Rule X. Additionally, the Oversight and Accountability Committee is the primary oversight committee of the US House of Representatives and has broad authority to investigate “any matter” at “any time.” under House Rule X.
