NYC Mayor Eric Adam's busing demand appears to be dead in the water.
In January, Adams filed suit against 17 bus companies used to transport immigrants from Texas to New York as the city sought injunctive relief. On Monday, Manhattan Supreme Court Justice Mary Rosado threw out the lawsuit.
“This is a simple attempt to regulate the transportation of indigent persons from state to state in violation of the interstate commerce clause,” the decision said.
“The Court finds that it cannot grant the Commissioner's request for a preliminary injunction, as the merits of her claim are dubious at best, given the large number of constitutional concerns.”
Lisa Zornberg, chief legal counsel for the mayor and City Council, conceded that the city will respect the court's decision, but argued that the “poor man's statute” on which the lawsuit was based “has not dictated, whether this law was constitutional or not”.
The statute in question was designed to prevent people from bringing others into the state “for the purpose of making it a public burden.”
“This lawsuit that we filed, which I'm very proud of, was really about using all the tools in the New York City toolbox to protect the New York City social service system and the New Yorkers,” Zornberg explained. “That's what that lawsuit was.”
The bus companies' attorney, Robert Hantman, praised Rosado “for his objectivity and integrity in following the law and ignoring political considerations.”
