Attorneys for the defendants argued that the case would be more appropriately heard in Carson City, where the signing ceremony took place, or in Douglas County, where the fraudulent voter documents were originally sent. The judge agreed with the defense, noting that Clark County's political leanings could affect the impartiality of a jury in this case.
After the ruling, Nevada Attorney General Aaron Ford expressed his intention to appeal the decision to the state Supreme Court. However, due to the expiration of a three-year statute of limitations in December, the state cannot refile the case in a different jurisdiction.

The six defendants, including Nevada GOP Chairman Michael McDonald and Republican National Committeeman Jim DeGraffenreid, were indicted in December on two counts each for their involvement in filing false election documents that purported to allocate electoral votes from Nevada to Trump.
The dismissal in Clark County is the first time a case related to the filing of false voters by the Trump campaign has been dismissed.
Attorneys for the defendants argued that the place where the alleged crimes took place should determine the appropriate jurisdiction for the case, citing a 2021 Nevada Supreme Court ruling.
They claimed the key documents were plotted and drafted outside of Clark County, making it an insufficient venue for trial.

In response, lawyers for the Nevada Attorney General's Office refused, claiming that no county had full jurisdiction over the case. Despite the state's arguments, Judge Holthus ultimately ruled in favor of dismissing the charges, stressing that the location of preparatory acts and the formation of intent were crucial factors in determining venue.
The outcome of this case highlights the complex legal battle surrounding the Trump campaign's efforts to submit a false list of voters in several swing states after the 2020 election.
