Missouri Gov. to Sign ‘2A Preservation Act’ Saturday – Report ⋆ Conservative Firing Line

Missouri Gov. Mike Parson will reportedly sign the Second Amendment Preservation Act Saturday afternoon, causing anti-gunners to gnash their teeth and suddenly discover the U.S. Constitution’s Supremacy clause.

According to the Kansas City Star, “Show Me” state conservatives have been pushing the legislation “for nearly a decade.” What helped was the arrival of the Biden administration with its promises of new gun control measures.

Predictably, the soon-to-become law has “been met by outrage and alarm from Democrats and gun control advocates, who have slammed the measure as dangerous in a state with such high rates of gun violence. Missouri had the nation’s third-highest per-capita rate of gun deaths in 2020,” the newspaper reported.

But Kelli Jones, a spokesperson for the Republican governor, countered, “The Governor is aware of the legal implications of this bill, but also that, now more than ever, we must define a limited role for federal government in order to protect citizen’s rights guaranteed by the Second Amendment of the United States Constitution.”

The new statute will not “nullify” federal laws. It only means state officials will ignore them.

According to Missourinet.com, House Bill 85 was sponsored by State Rep. Jared Taylor (R-Nixa) and State Sen. Eric Burlison (R-Battlefield). The legislation says it is the duty of law enforcement and the courts to protect rights of law-abiding citizens, and it declares all federal laws that infringe on the Second Amendment to be invalid.

The history of this effort once again shows the philosophical divide between Democrats and Republicans. While Gov. Parson will ink the legislation, former Gov. Jay Nixon, a Democrat, vetoed the bill in 2013 and the Legislature failed to override, Missourinet.com recalled.

Tara Bennett, a volunteer with the anti-gun-rights Moms Demand Action, issued a statement quoted by the Kansas City Star.

“This bill has no benefit,” Bennett said, “and will interfere with the enforcement of the critical protections that help keep Missourians safe from gun violence. There is no doubt this bill should not become law.”

When the bill becomes law, it will not prevent federal agents from enforcing federal statutes.

But in its opening paragraph, the Star newspaper report said, “Missouri police will be barred from enforcing federal gun laws that regulate weapons registration, tracking and possession of firearms by some domestic violence offenders…”

However, all Missouri gun laws will remain in effect, Burlison told reporters.
