In a major blow to Secretary of State Jocelyn Benson's ambitions for election chaos in Michigan, Judge Christopher Yates has ruled that the Election Handbook sent to election officials statewide is unconstitutional and contrary to state law. This ruling also paves the way for strict signature verification of mail-in ballots, making it harder for fraudsters to rig elections.

Judge Yates stated: “The Court declares that the “initial presumption'' of validity in the signature verification of absentee ballot applications and envelopes imposed by the December 2023 guidance manual issued by the defendants is inconsistent with the Constitution and laws of the State of Michigan.”

This strong ruling forces the elimination of the problematic provisions of the guidance manual and the capture line, while maintaining the validity of R 168.24. Democrats like Benson, who said the handbook provided clear guidelines for local employees about verifying signatures, have been contradicted by the court's decision.

Benson, a staunch Democrat, defended the handbook, citing the Voting Rights Amendment to the Michigan Constitution. However, it was the Republican National Committee, along with other plaintiffs, that challenged those guidelines.

Assistant Attorney General Heather Meingast, representing Benson, argued that the controversial guidelines were necessary for local employees to understand the important discrepancies and differences.

But GOP attorney Robert Avers disagreed, saying multiple safeguards are already in place to prevent disenfranchisement, including the constitution's early voting window, which gives voters and election officials time to to correct discrepancies. He noted that voters receive a text message when their absentee ballot is rejected, ensuring transparency in the process.
