Letitia James 'overzealous' attacked by NYPD union for indicting cop in death of suspected drug dealer

The Sergeants Benevolent Association (SBA), a union representing the New York City Police Department (NYPD Sgts., has criticized New York Attorney General Letitia James for charging Sgt. Erik Death of suspected drug dealer Eric Duprey.

Working undercover in August, Duran was trying to bust Duprey, 30, for selling narcotics in the Bronx.

Duprey, who had previously sold crack to Duran, took off on a scooter, driving 40 mph along a sidewalk lined with pedestrians and children. The sergeant allegedly threw a cooler at the fleeing trafficker. Duprey lost control of his scooter and crashed into a tree. The suspect suffered “blunt force injuries to the head” according to authorities and later died from his injuries.

According to the SBA, Duprey had felony charges pending against him at the time of the pursuit. If Duran hadn't stopped him, Duprey would have charged at him and the other officers at the scene.

On Tuesday, Sgt. Duran is expected to surrender at the Bronx Courthouse.

“The demonization of Sgt. Duran and the criminalization of his actions proves once again the old adage that overzealous prosecutors with a political agenda can indict a ham sandwich if they're willing to,” said the president of the SBA, Vincent Vallelong, in a statement obtained by the New York Post.

“Sgt. Duran made a split-second decision based solely on his concern for the safety of others,” Vallelong continued. “Now he has become the latest victim of a legal system that treats police officers honest and hardworking as criminals and criminals as victims.”

Had Duran not acted, the SBA argued, the drug deal would have “caused serious injury or death to numerous people.”

Law enforcement sources told The Post that after the incident, members of Duprey's family in Pennsylvania, seeking retaliation, “hit out” Sgt. Duran's boss.

If the attorney general's office had “properly investigated” the incident, the SBA leader said, they would have found that Duran's actions were “justified, justified and lawful.”

“Instead, the attorney general has once again shown his arrogance at the expense of a well-respected NYPD sergeant who did the right thing,” Vallelong said.

Vallelong called on SBA members to “pack” the Bronx Hall of Justice on Tuesday in solidarity with Duran and warned NYPD officers to be careful because “any action you take can cause a political ideologue to “Albany destroy your career to advance his.”

“If you're going to sue this case and you're going to win, you have to sue every real estate developer everywhere. That's all they do. That's what they do all day every day. So I don't think this thing will ever survive on appeal, regardless of what the fine is. That doesn't even make sense,” O'Leary told CNN earlier this month.

“Now look, I understand that Trump has a lot of problems in other impeachments and everything else,” he said, “but if you're a real estate developer, you're looking at this and you're like, 'What is this? This is ridiculous.'”

And on Thursday, former New York Governor Andrew Cuomo claim filed against James seeking documents related to his investigation into his alleged sexual misconduct that forced him to step down in 2021.

According to Cuomo, “every piece of information that has come out over the past two years has done nothing but undermine Tish James' false report, and after publicly stating that 'evidence will be made available to the public,' he has done everything she can hide these documents from taxpayers”.
