In his decision, he asserted that Texas provided sufficient evidence demonstrating that the funds are not being used to build additional border walls, which Texas officials argue would reduce illegal immigration. The Biden administration now has a seven-day window to appeal the injunction.

In response to the ruling, Texas Attorney General Ken Paxton criticized the Biden administration’s approach. Paxton’s statement accused President Biden of supporting open borders by not directing the allocated funds towards their original purpose of constructing border barriers.

Bush, then-commissioner of the Texas General Land Office, and Paxton filed a lawsuit against the Biden administration after the president halted new border wall construction projects. President Biden has stated that his administration is legally obligated to proceed with certain border wall construction projects since Congress appropriated the funds prior to his presidency.
