Department of Justice (DOJ) attorneys would not tell a J6 defendant’s attorney if the intended witnesses in the case were FBI informants.
The prosecution’s refusal to release the critical information came after the government revealed that a planned witness had been an informant. The revelations come via a court transcript obtained by Julie Kelly of American Greatness.
Defendants in the case are former Proud Boys National President Enrique Tarrio and members Ethan Nordean, Joseph Biggs, Zachary Rehl and Dominic Pezzola. The defendants are accused of allegedly engaging in a seditious plot to overthrow the US government.
The DOJ said Wednesday that a defense witness for Enrique Tarrio, himself a former FBI informant, had been a confidential human source (CHS) for the bureau from April 2021 to January 2023 Tarrio’s attorney, Sabino Jauregui, said at Thursday’s hearing that he asked the DOJ if his next two witnesses were also FBI sources, Kelly noted.
– Do you know what they told me? Jauregui said. “Nothing. They don’t know.”

The New York Times has identified the female source as Jen Loh, a former member of “Latinos for Trump.”
Loh, the confidential FBI source, had 20 to 30 communications with Biggs, his attorney, Norman Pattis, said at Thursday’s hearing.
Loh said in an interview Friday that he provided “useful information” about left-wing protesters to the FBI and then briefed the bureau on “any kind of domestic terrorism, right-wing or left-wing,” he reported the NYT.
FBI Special Agent in San Antonio Kristina Spindel swore in a deposition Thursday that Loh had been giving information to the FBI since the fall of 2019.
Pattis told President Judge Timothy Kelly that the defense was “very close to a stipulation of up to eight or nine more” FBI sources.
“There was a complex web of confidential human sources available to the government,” Pattis said.
“My biggest concern is the fact that we still have confidential human sources that are unknown to us,” said Rehl’s attorney, Carmen Hernandez.
But Judge Kelly rejected a defense subpoena Tuesday for Proud Boys member Kenneth Lizardo. Kelly ruled that Lizardo had “an information relationship with the FBI” and had stated his intention to testify against the Fifth if called to testify.
Lizardo was an associate of Tarrio’s who went with him to a meeting on January 5, 2021 in Washington, DC with the founder of the militia group Oath Keepers, Stewart Rhodes.
Rhodes was eventually convicted of participating in a seditious conspiracy related to January 6 in November 2022.
According to the NYT, the FBI had as many as eight informants inside the Proud Boys group in the months surrounding the January 6 Capitol riot. This includes a period of time both before and after the event. The former leader of the Tennessee Proud Boys chapter, Matthew Walter, told the Times in February that about 20 members of the group besides him had ties to the FBI at the time.
