GOP blocks activist judge nomination. Is this who Biden wanted?

With the help of at least one Democrat, Senate Republicans managed to block a key judicial nomination on Thursday.

In April, President Joe Biden nominated Judge Sarah Netburn, a junior magistrate judge, to serve on the United States District Court for the Southern District of New York.

There was just one problem: she's a radical with little recognition for women's rights.

The evidence includes the fact that in 2022 he recommended that a twice-convicted 6'2″ biological male SEX DEFENDER be housed in a women's prison.

“At the time, the judge, Sarah Netburn, dismissed concerns that the inmate's presence there would pose a threat to incarcerated women,” according to the Washington Free Beacon. “Netburn made the recommendation over the objections of federal prison officials, stating that concerns that his presence would be 'traumatizing and possibly dangerous' were 'overblown.'”

But she was very wrong. Transgender criminal William McClain, aka “July Justine Shelby,” continued to expose himself to his female inmates, surprise, surprise.

“According to Debra Nizza, a former Carswell inmate released in 2016 who stays in touch with inmates at the federal women's prison at Carswell in Texas, an inmate told her that McClain pulled his penis out of his pants before a group of inmates,” as he explained. the Free Lighthouse

“Nice [said] that an inmate related to him that Shelby told the women that his penis was “intact” and still working before waving it around with the women,” Beacon noted.

This was a big selling point for Republicans.

“Putting political ideology above justice and reality, Magistrate Judge Netburn recommended that Shelby be moved immediately to a women's facility,” Sen. Ted Cruz said before Thursday's vote.

“This judge rules that the Constitution requires that biological men who one day wake up and say I'm a woman must be housed with prisoners. This judge has also ruled in effect that the prisoners have no rights”, he added.

The argument convinced at least one sane Democrat, Sen. Jon Ossoff, to vote with the Republicans.

“I am concerned about the wisdom of the matters discussed in the session,” he said News from the Court after Thursday's vote, referring to Netburn's decision to house McClain with women. “These are very difficult decisions for prison officials and for judges.”

All of this also comes after Senator Lindsey Graham recently exposed Netburn for being anti-science. He reportedly asked her during a hearing whether it is possible to determine a person's biological sex by examining their chromosomes.

The answer is a resounding yes.

However, this is what Netburn had to say: “I have never studied biology and am therefore not qualified to answer this question.”

BAD!

Netburn's nomination was also opposed by the Independent Women's Forum.

“It would be devastating enough if Magistrate Judge Netburn simply enforced a law that created prisons based on gender identity,” the group said in a statement. “But that's not what happened. Magistrate Judge Netburn invented a provision in the Constitution to coincide with her progressive politics.”

“Judge Netburn twisted beyond recognition the Eighth Amendment's ban on cruel and unusual punishment into a mandate that transgender men who identify with women's prisons. This type of ruling causes the public to lose faith in the rule of law, because the law becomes the whim of a judge, rather than the end result of a hard-won democratic process,” the statement continued.

It concludes with the group's director, Ma Mailman, urging the Senate Judiciary Committee to “reject President Biden's nomination of Judge Netburn.”
