Former federal prosecutor teases how jury could 'punish' Trump's 'portfolio' in E. Jean Carroll trial

Former federal prosecutor Temidayo Aganga-Williams advanced how the jury in former President Donald Trump's libel trial against E. Jean Carroll in New York could punish him financially on MSNBC Friday.

“The punitive damages, that's really the number we're interested in here because it's about punishing the former president. It's about the jury teaching him a lesson, saying 'How much money would it take for you to stop doing this?'” Aganga-Williams said. “What's important to know is that at law, punitive damages are not the norm in cases. … You need something — some kind of behavior, some kind of bad intent to do something egregious here.”

“I think the fact that we're likely to see a high number of punitive damages will reflect that the jury is saying that…” You weren't just attacking her or committing a crime against her, you did something so bad that you have to do a high number that will hurt your pocket that you will not do it again'”, he added.

Trump's testimony about his immense wealth could also lead to the jury getting a higher number to convict him, Aganga-Williams said.

“This jury has a big question: 'Are you going to $10, $20, $30, $40, $50, $60 million?' And they can all have disagreements there. So, frankly, I would bet by the end of Monday that we have a decision for sure, maybe by the end of today,” Aganga-Williams said.

“On the punitive front, there has to be some reasonableness,” he explained. “And what I'm hoping to see, if they come back with a number that's really astronomical, the judge might reduce it to make it more tied to what he sees the facts are, but they have a lot of leeway to decide what the number is going to be. “
