Federal judge throws out lawsuit claiming Trump can’t run for office under 14th amendment

-

A federal judge has thrown out a lawsuit filed by a Florida prosecutor’s attorney who claimed former President Donald Trump could not run for office for fomenting an insurrection.

Judge Robin L. Rosenberg ruled that Lawrence Caplan, who filed the challenge, had no particular legal injury to file a federal lawsuit about the former president and the 14th Amendment.

“Plaintiffs lack standing to challenge defendant’s qualifications to seek the presidency, as the alleged injuries are not cognizable and are not particular to them,” the judge wrote, he said. The Washington Times.

Caplan had argued in his filing this a clause in the 14th amendment this says that those who have “participated in an insurrection or rebellion” against the government cannot hold office.

“The bottom line is that President Trump engaged in an insurrection and also gave aid and comfort to others engaged in such actions, within the plain meaning of those terms as defined in Section Three of the 14th Amendment.” , Caplan wrote. in the filing, citing the Capitol riot of January 6, 2021, according to the hill

“Assuming the public record to date is accurate, and we have no evidence to the contrary, Trump is no longer eligible to seek the office of President of the United States or any other state in the Union,” he continued.

Harvard Law School Professor Emeritus Alan Dershowitz has it get up doubts about the idea that Trump can’t run because of the 14th Amendment, saying it’s a “serious danger” to the Constitution.

“It would put the decision about who is president in the hands of local secretaries of state and Democratic governors, instead of the people,” Dershowitz said in an interview with “Just news, no noise” Television show.

As of now, Trump remains the clear favorite for the GOP nomination for president, according to current polls.
