Due process? Garland urges 'swift' Trump trial, cites 'public interest'

Supporters of former President Donald Trump are crying foul over Attorney General Merrick Garland's claim that a “speedy trial” would be in the public's best interest.

Speaking earlier this week to CNN about the federal government's election tampering case against Trump, the AG argued that speeding up the case would be in the public's best interest.

He made the argument after a CNN interviewer noted that most Republicans believe the former president is being attacked for political reasons.

“Are you concerned that this public perception exists, and what can you do to change it?” Evan Perez asked.

“Of course I'm concerned,” Garland replied. “What we have to do is demonstrate with the acts we do that we follow the law, that we follow the facts.”

“The prosecutions you're talking about began last year, and the special prosecutor has said from the beginning that he believes the public interest requires a speedy trial, which I agree with. And now the matter is in the hands of the judge of first instance to determine when the trial will take place”, he added.

But critics say that's problematic because it denies Trump his due process rights.

“The speeding up of the deadline has raised constitutional concerns because the Sixth Amendment not only guarantees the accused the right to a 'speedy and public trial,' but also guarantees the accused the right to prepare a full defense,” he say Chris Enloe. Blaze News notes

“So the question is whether giving Trump just seven months to prepare a defense will protect his due process rights,” he continues.

Critics say the answer to that is a resounding no.

“The Sixth Amendment grants the right to a speedy trial for the accused,” a critic he tweeted. “Not in the 'public interest.' Not for prosecutors. Trump is not above the law. But he's not below it either. He's entitled to due process. There's no fast food trip through a judicial procedure

Critics say Garland's “fast track” remarks are also problematic because they indicate she is trying to interfere in the upcoming 2024 presidential election.

“Garland openly admits she approves of election interference,” one critic he tweeted. “The Government does NOT have the right to a speedy trial, that right belongs to an accused. The government waited 30 months to file charges, now they want to hurry. The rush is to interfere in the elections.”

“The timing of these lawsuits is incredible, considering they could have filed charges against Trump a long time ago, but decided to do it right before the election to bring him down,” another critic wrote. “This administration continues to stick it to the American people in every way possible.”
