A New York appeals court on Thursday rejected President Donald Trump's bid to throw out a gag order imposed on him in his civil fraud trial in New York, along with fines imposed by violations
the court Found that Trump had not used the proper legal method to challenge the order imposed in October by Judge Arthur Engoron. Trump's lawyers asked the court in November to vacate the gag order using a provision in the law to sue Engoron directly, which the court found to be an inappropriate “extraordinary remedy” when the “potential harm it's small.” seconds on ABC News.
“Here, the seriousness of the potential harm is small, given that the Gag Order is limited, limited to prohibiting only statements about court personnel,” the court wrote. “Furthermore, although the gag order and contempt orders were not issued pursuant to formal motion practice, they are reviewable through the ordinary appellate process.”
The gag order prohibits Trump and other parties in the case from speaking publicly about Engoron's staff. Engoron imposed it after Trump made a post on Truth Social about his lawyer Allison Greenfield, referring to her as the “girlfriend” of Senate Democratic Majority Leader Chuck Schumer.
“To the extent that there were appellate issues with respect to any of the procedures that the court implemented in imposing the financial penalties, the appropriate method of review would be to proceed to vacate the contempt orders and then appeal of the denial. of these motions,” the ruling continued.
The New York Appellate Division, First Judicial Department temporarily stayed the order on November 16, but restored in november 30
Trump was fined twice for violations of the order, first for $5,000 after he failed to remove the post about Greenfield from his campaign website for 17 days after the order was issued and the second for $10,000 after he said to reporters that the person sitting next to Engoron was “very partisan.”
