Three years after Jan. 6, the Justice Department indicated that thousands more Americans could be in the crosshairs of prosecutors, even if they never entered the U.S. Capitol.
This week, the commemoration of the pearling colloquially called “Sixthmas” has been marked in Washington, DC and elsewhere with crocodile tears and “survivor” accounts. In furthering the historical disclosure of what actually took place when Congress met to certify the 2020 presidential election, a DOJ official indicated that even more people present that day could be charged with a federal crime.
Speaking for about an hour Thursday, President Joe Biden-appointed U.S. Attorney for the District of Columbia, Matthew Graves, discussed the expiration of the statute of limitations, set for Jan. 5, 2026, and the intent of the Department of Justice, as Attorney General Merrick Garland said. that, “hold all the perpetrators of January 6 accountable at any level under the law, whether present that day or otherwise criminally responsible for the assault on our democracy.”
“It has been three years since a violent mob attacked our Capitol,” began Graves, who likened the breach in the U.S. Capitol to “scenes often reminiscent of a medieval battle.”
During his account, the U.S. attorney ominously suggested an expanded reach of the law beyond those who engage in violent behavior and against those who express concerns about the integrity of the 2020 election.
“An important note when it comes to our prosecutions of those who stayed outside the building. We have used our prosecutorial discretion to focus primarily on those who entered the building or those who engaged in conduct violent or corrupt for Capitol reasons,” the official said. “But if a person entered the restricted area without authorization, they had already committed a federal crime. Make no mistake, thousands of people occupying the area they were not authorized to be in in the first place.”
Graves' statement was interpreted by many as a signal from the Justice Department, already under investigation for having been politically armed by the administration, that “anyone who never entered [the] The Capitol at J6 will be haunted.”

“What a destructive exercise,” columnist Miranda Devine expressed in response as others reacted with calls for “tyranny” and suggesting this was “his election strategy.”

While it remains to be seen how many people the DOJ will actually prosecute after Graves' plea, the Associated Press criticized the more than 1,230 charged with federal crimes “ranging from misdemeanors like breaking and entering to felonies like assault to police officers and the seditious conspiracy”.
“Approximately 730 people have pleaded guilty to the charges, while another 170 have been convicted of at least one charge in a trial decided by a judge or jury,” he continued, citing his own database.
Biden also got caught up in Friday's narrative with his penchant for telling stories that led him to reminisce while pushing the boundaries of reality. “Jill and I attended the funerals of the police officers who died as a result of the events that day.” claimed the president speaking from Valley Forge, Pennsylvania. “Because of Donald Trump's lies. They died because those lies brought a crowd to Washington.”
