The Biden administration has increased student loan forgiveness for another 74,000 borrowers despite a Supreme Court ruling that struck down his student loan relief plan last June.
The White House made the announcement Friday. This brings the total number of borrowers who had their loans partially or fully written off to more than 3.7 million Americans. In fact, it will forgive $4.9 billion in student debt, according to the report CNBC.
The Biden administration has cited the Higher Education Student Aid Opportunity Act of 2003 (HEROES Act) as justification for thumbing its nose at the Supreme Court and eliminating student loans. Biden says loan forgiveness is allowed in the event of a “national emergency.” SCOTUS did not accept this argument.
“My administration is able to provide relief to these borrowers, and millions more, because of the fixes we made to broken student loan programs that prevented borrowers from getting the relief they were entitled to under the law. The announcement by 'today adds to everything we've been able to accomplish for students and student loan borrowers in recent years,' President Biden said in a statement of the White House.

“And in the wake of the Supreme Court's decision on our student debt relief plan, we continue to look for an alternative path to deliver student debt relief to as many borrowers as possible,” he hinted. to the fact that he is evading the law.

The move blatantly defies the Supreme Court ruling against Biden's plan and has outraged millions of people who have paid off their loans but will now have to pay the bill for those who refused to do so.
There is no plan to “eliminate” student loan debt.
Just a plan to transfer the debt from those who currently owe it, to the rest of us.

“The secretary could issue these exemptions or modifications only “as necessary to ensure” that “recipients of student financial aid pursuant to title IV of the [Education Act affected by a national emergency] are not in a worse economic position in relation to this financial assistance because of [the national emergency]”, added the medium.
Canceling student loan debt is unconstitutional.
The Supreme Court has already ruled on this.

“The text of the HEROES Act does not authorize the Secretary's loan forgiveness program. The Secretary's power under the Act to “amend” does not permit “basic and fundamental changes in the scheme” designed by Congress. MCI Telecommunications Corp. v. American Telephone & Telegraph Co., 512 US 218, 225. In contrast, “modify” has “a connotation of augmentation or limitation” and should be read to mean “to change moderately or less.” This is how the word is commonly used and defined, and the legal definition is no different,” says the Supreme Court's majority opinion.
Republicans accuse the Biden administration of further increasing student loan forgiveness as a way to sway the 2024 presidential election.

The US Supreme Court ruled that student loan forgiveness was unconstitutional. However, three times since this administration, Biden has written off more debt.
