Alan Dershowitz slams New York court for upholding Trump gag order

Prominent attorney Alan Dershowitz criticized the New York Court of Appeals on Tuesday after it upheld a gag order against former President Donald Trump.

New York Judge Juan Merchan imposed a gag order expanded on April 1 after Trump criticized the judge's daughter, Loren Merchan, in several posts on Truth Social, including one link to a New York Post report about Loren Merchan's firm helping Democratic causes raise $93 million from Trump accusation in the case. Dershowitz criticized the court on “The Dershow” for claiming in the decision let the gag order that “there was no constitutional issue” raised by Trump's appeal stand.

“I want to complain to the New York Court of Appeals again,” Dershowitz said. “They said there was no constitutional question, not a constitutional question when you have prior restraint against a man running for president. You know, we've been around for almost 250 years. It's hard to imagine, from now on 250 years, a clearer violation of the Constitution than a prior restriction against a man running for the presidency of the United States prohibiting him from complaining about the judge's daughter, a clerk, some witnesses, jurors, he has a right to that . The most important thing is that we have a right to this. We have a right to hear their views on this.”

I WILL SEE:

Dershowitz addressed the Connecticut Bar Association on Friday liberation in which he claimed he was calling Trump's trial that resulted in his own conviction in 34 the crime counts with a “farce” or describing it as “deluded” or “corrupt” “had no place in public discourse”.

“I haven't decided who to vote for,” Dershowitz said. “I want to hear from Donald Trump. I want to hear what he has to say about the trial. I want to hear what the people involved in the trial have to say. I want a debate. I want a discussion. I want a marketplace of ideas. I don't want them New York courts close the marketplace of ideas, and I don't want the Connecticut bar to close the marketplace of ideas.”

“Nothing is more important than free speech, especially during a presidential election, but we're not getting it,” Dershowitz continued. “We're having the New York district attorney use a criminal indictment that has a sword and then use a gag order as a shield against criticism. It's totally unfair and totally unconstitutional and if the Court of Appeals for New york does not believe there is a constitutional problem with prior restraint against the man running for president come to my constitutional criminal law class come to my first amendment class read my writings of the First Amendment, listen to my podcast, I think… read the First Amendment! Read the First Amendment!”
