Democratic Manhattan District Attorney Alvin Bragg is not taking a position on former President Donald Trump's request to delay his sentencing date in New York, according to a document filed Friday.
Trump's lawyers he asked Judge Juan Merchan last week pushed back his ruling, currently set for September 18, until after the November elections. In a filingBragg's office said it would “defer to the Court” if a delay is necessary to “allow for orderly appellate litigation,” and wrote that they are “prepared to move for judgment at any future date that the Court fix”.
“The Village also notes that significant public safety and logistical steps are necessary by various agencies to prepare for court appearances in this matter,” prosecutors wrote.
Last week, Trump's lawyers argued that a delay is needed to ensure they have “adequate time to evaluate and pursue state and federal appeals options” if Merchan rejects his motion to set aside the verdict of the jury based on that of the Supreme Court sentence on presidential immunity. Merchan has said he intends to rule on the motion on Sept. 16.
Trump was condemned in May on 34 charges of falsifying business records.
Prosecutors acknowledged Trump's intention to immediately appeal any adverse decision “may mean significant preparatory steps are taken, only for those steps to be altered by appellate litigation.” However, they said none of Trump's other arguments “deserve any consideration.”
